SECRETARY OF INFRASTRUCTURE, COMMUNICATIONS AND TRANSPORTATION

DECRETO por el que se declara área prioritaria para el desarrollo nacional, la prestación del servicio público de transporte ferroviario de pasajeros en el Sistema Ferroviario Mexicano.

DECREE declaring a priority area for national development, the provision of public passenger rail transport service in the Mexican Railway System.

ANDRÉS MANUEL LÓPEZ OBRADOR, presidente de los Estados Unidos Mexicanos, en ejercicio de la facultad que me confiere el artículo 89, fracción l, de la Constitución Política de los Estados Unidos Mexicanos, con fundamento en los artículos 25 y 28, párrafo cuarto, de la propia constitución; 36 de la Ley Orgánica de la Administración Pública Federal; 1, 6, 37 fracción I de la Ley Reglamentaria del Servicio Ferroviario, y 58 y 101 del Reglamento del Servicio Ferroviario, y

CONSIDERANDO

CONSIDERING

Que el ferrocarril desde su nacimiento en el mundo en 1769 ha jugado un papel fundamental en el progreso socioeconómico de las naciones, sin ser nuestro país la excepción;

That the railway, since its birth in the world, has 1769 has played a fundamental role in the socioeconomic progress of nations, without our country being the exception;

Que el ferrocarril en México fue crucial en el desarrollo de fines del siglo XIX y principios del XX, fomentó la integración del territorio nacional, redujo las distancias y facilitó el movimiento de personas y mercancías. Asimismo, su construcción permitió la explotación de recursos en zonas remotas, estimuló la agricultura y la minería, y favoreció el establecimiento de nuevas poblaciones y el crecimiento económico. Que en este 2023, se cumplen 150 años de la instalación del primer ferrocarril de pasajeros en México que iniciara el presidente Benito Juárez García y concluyera el presidente Sebastián Lerdo de Tejada de México a Veracruz. Posteriormente la red ferroviaria conectó a México con los mercados internacionales, principalmente con Estados Unidos de América, lo que incrementó el comercio y la inversión extranjera;

That the railroad in Mexico was crucial in the development of the late 19th and early 20th centuries, fostering the integration of the national territory, reducing distances, and facilitating the movement of people and goods. Likewise, its construction allowed the exploitation of resources in remote areas, stimulated agriculture, and mining, and favored the establishment of new towns and economic growth. That in 2023, it will be 150 years since the installation of the first passenger railway in Mexico, initiated by President Benito Juárez García and completed by President Sebastián Lerdo de Tejada from Mexico to Veracruz. Later, the railway network connected Mexico with international markets, mainly with the United States of America, which increased trade and foreign investment;

Que por tratarse de una industria estratégica, en el año 1937, el presidente Lázaro Cárdenas concretó la rectoría del Estado en la operación y la prestación del servicio público ferroviario de carga y pasajeros. Las principales rutas fueron:

Que fue realmente una desgracia el que el presidente Ernesto Zedillo Ponce de León, continuador de la política salinista, haya privatizado los ferrocarriles en México, pues el 2 de marzo de 1995, se publicó en el Diario Oficial de la Federación la reforma al cuarto párrafo del artículo 28 constitucional. Dicha reforma sustituyó el régimen de participación exclusiva del Estado en los ferrocarriles a fin de permitir la participación de privados mediante el otorgamiento de concesiones. En consecuencia, el 12 de mayo del mismo año, se promulgó la Ley Reglamentaria del Servicio Ferroviario la cual permitió al ejecutivo otorgar el 84.5% de las vías principales existentes a manos de privados;

That it was truly a disgrace that President Ernesto Zedillo Ponce de León, continuator of the Salinas policy, privatized the railways in Mexico, as on March 2, 1995, the reform to the fourth paragraph of article 28 of the Constitution was published in the Official Daily of the Federation (DOF). This reform replaced the administration of exclusive State participation in the railways in order to allow private participation through the granting of concessions. Consequently, on May 12 of the same year, the Regulatory Law of the Railway Service was promulgated which allowed the executive to grant 84.5% of the existing principal routes to private hands;

Que, a finales de los noventa, el Gobierno Federal, por conducto de la entonces Secretaría de Comunicaciones y Transportes, otorgó en concesión las vías troncales que corren al norte del país y las vías cortas del sureste, manteniendo bajo su control, únicamente, el ferrocarril del Istmo de Tehuantepec. Es decir, se entregaron en esencia a dos empresas con distintas denominaciones, 17,484 kilómetros de vía y se canceló el servicio de trenes de pasajeros;

That, at the end of the nineties, the Federal Government, through the then Secretary of Communications and Transportation (SCT), granted concessions to the trunk routes that run to the north of the country and the short routes to the southeast, maintaining under its control only the Railway of the Isthmus of Tehuantepec. That is to say, essentially two companies with different names were delivered 17,484 kilometers of track and passenger train service was cancelled;

Que pensando que el Estado nunca haría uso de sus atribuciones de promover el desarrollo y cumplir su responsabilidad social, se dejó en los títulos de concesión vigentes una cláusula que establece:

La Secretaría podrá otorgar concesiones a terceras personas o derechos a otros concesionarios para que, dentro de la Vía Férrea señalada en el numeral 1.2.1, éstos presten servicio público de transporte ferroviario, en los términos siguientes:

The Secretary may grant concessions to third parties or rights to other concessionaires so that, within the Railway routes indicated in section 1.2.1, they may provide public rail transport service, under the following terms:

1.4.2.1. Tratándose del servicio de pasajeros, en cualquier tiempo…”

“3.1. Concesiones a terceros.

El Concesionario estará obligado a otorgar los derechos de paso o derechos de arrastre a las personas a quienes, de conformidad con lo dispuesto en este numeral, la Secretaría otorgue concesión, en los términos señalados en el siguiente numeral.

The Concessionaire will be obligated to grant the rights of passage or hauling rights to the persons to whom, in accordance with the provisions of this section, the Secretary grants a concession, under the terms indicated in the following section.

Lo anterior, en el entendido de que el Concesionario estará obligado a proporcionar todas las facilidades que se requieran para que el servicio de transporte de pasajeros se ajuste a los itinerarios correspondientes.”

The foregoing, with the understanding that the Concessionaire will be obligated to provide all the facilities required so that the passenger transportation service adjusts to the corresponding itineraries.”

Que es de interés del Gobierno de México, impulsar la implementación de ferrocarriles de pasajeros que permitan mejorar la calidad de vida, el bienestar y la movilidad de las personas en virtud de que representa: (I) un transporte público económico; (II) un transporte público menos contaminante, (sobre todo considerando que este puede modernizarse para convertirse en transporte eléctrico); (III) un transporte público más seguro; y (IV) la mejor alternativa para incrementar la movilidad de la población en las principales ciudades. Por todo lo anterior, he tenido a bien expedir el siguiente:

That it is in the interest of the Government of Mexico to promote the implementation of passenger railways that improve the quality of life, well-being and mobility of people by virtue of the fact that it represents: (I) economical public transportation; (II) less polluting public transport (especially considering that it can be modernized to become electric transport); (III) safer public transportation; and (IV) the best alternative to increase the mobility of the population in the main cities. For all of the above, I have seen fit to issue the following:

DECRETO

DECREE

PRIMERO. Se declara área prioritaria para el desarrollo nacional la prestación del servicio público de transporte ferroviario de pasajeros en el Sistema Ferroviario Mexicano.

FIRST. The provision of public passenger rail transport service in the Mexican Railway System is declared a priority area for national development.

SEGUNDO. En las vías generales de comunicación ferroviaria concesionadas, se dará preferencia a la prestación del servicio público ferroviario de pasajeros y se respetará el servicio público de transporte ferroviario de carga en términos de lo dispuesto en la concesión respectiva.

SECOND. On the concessioned general railway routes of communication, preference will be given to the provision of public passenger railway service and the public railway freight transport service will be respected under the terms of the provisions of the respective concession.

TERCERO. Los concesionarios del servicio público de transporte ferroviario de carga serán los primeros en ser invitados para presentar los proyectos para la implementación del servicio ferroviario de pasajeros, dentro de sus vías generales de comunicación ferroviaria que les fueron otorgadas en concesión. Los interesados deberán presentar sus propuestas ante la Secretaría de Infraestructura, Comunicaciones y Transportes a más tardar el 15 de enero de 2024.

THIRD. The concessionaires of the public freight rail transportation service will be the first to be invited to present projects for the implementation of the passenger rail service, within their general rail routes of communication that were granted to them in concession. Interested parties must submit their proposals to the Secretary of Infrastructure, Communications and Transportation no later than January 15, 2024.

CUARTO. En caso de que los concesionarios del servicio público de transporte ferroviario de carga no presenten propuesta viables en inversión, tiempo de construcción, modernización de vías para otorgar el servicio de pasajeros o no manifiesten su interés y aceptación en el plazo establecido en la cláusula anterior, el Gobierno Federal, a través de la Secretaría de Infraestructura, Comunicaciones y Transportes, podrá otorgar títulos de asignación a la Secretaría de la Defensa Nacional o a la Secretaría de Marina, que ya operan el Tren Maya y el Tren del Istmo de Tehuantepec, o en su caso, a particulares que presenten propuestas y estén interesados en prestar el servicio de transporte ferroviario de pasajeros en términos de lo dispuesto por la Ley Reglamentaria de los Servicios Ferroviarios y su Reglamento.

FOURTH. In the event that the concessionaires of the public freight rail transport service do not present viable proposals in terms of investment, construction time, track modernization to provide passenger service or do not express their interest and acceptance within the period established in the preceding clause, The Federal Government, through the Secretary of Infrastructure, Communications and Transportation (SICT), may grant assignment titles to the Secretary of National Defense or the Secretary of the Navy, which already operate the Maya Train and the Isthmus of Tehuantepec Train, or where appropriate, to individuals who present proposals and are interested in providing the rail passenger transport service in terms of the provisions of the Regulatory Law of Railway Services and its Regulation.

Las primeras siete rutas que se concesionarán serán las siguientes, y deberán considerar preferentemente las estaciones que se encontraban en operación antes del año 1995:

The first seven routes that will be concessioned will be the following, and must preferably consider the stations that were in operation before 1995:

QUINTO. La regulación del servicio público de transporte ferroviario de carga y de pasajeros, así como la implementación del presente Decreto, estará a cargo de la Secretaría de Infraestructura, Comunicaciones y Transportes y de la Agencia Reguladora del Transporte Ferroviario, en el marco de sus respectivas atribuciones.

FIFTH. The regulation of the public rail transport service for cargo and passengers, as well as the implementation of this Decree, will be the responsibility of the Secretary of Infrastructure, Communications and Transport (SICT) and the Regulatory Agency for Railway Transport, within the framework of their respective powers.

TRANSITIONAL ARTICLE

ÚNICO. El presente decreto entra en vigor el día de su publicación en el Diario Oficial de la Federación.

SOLE. This decree takes effect on the day of its publication in the Official Daily of the Federation.
