THE IMPORTATION OF VEHICLES ADAPTED FOR HANDICAPPED PERSONS

No se pagaran los impuestos al comercio exterior por la entrada en territorio nacional de vehículos especiales o adaptados para personas con discapacidad, siempre que se cumpla con los requisitos que señala la legislación aduanera.

Duties will not be paid on the entry to National territory of special vehicles or vehicles adapted for handicapped persons, provided that they comply with the requirements stipulated in the Customs legislation.

¿Quiénes pueden importar un vehículo de estas características?

Who can import a vehicle with these characteristics?

• Las personas con discapacidad o su representante legal.

·        Handicapped persons or their legal representative.

• Las personas morales no contribuyentes autorizadas para recibir donativos deducibles del impuesto sobre la renta, que tengan como actividad la atención a personas con discapacidad.

·        Non-profit companies authorized to receive income tax deductible donations which have as their activity the attention to handicapped persons.

• Para efectos de las disposiciones aduaneras se considera personas con discapacidad aquellas que debido a la pérdida o anormalidad de una estructura o función psicológica, fisiológica o anatómica, sufren la restricción o ausencia de la capacidad para realizar una actividad en la forma o dentro del margen que se considera normal para un ser humano.

·        For the purposes of these customs provisions, handicapped persons are considered those persons that due to loss or structural abnormality or psychological, physiological, or anatomical function, suffer the restriction or absence of capacity for performing an activity in the form or within the margin that are considered normal for a human being.

¿Qué personas pueden realizar el trámite?

Which persons can perform this procedure?

• La propia persona que tiene la discapacidad.

·        The same person that has the handicap.

• Quien tenga la patria potestad, tratándose de menores de edad discapacitados.

·        He who has paternal rights, with respect to handicapped minors.

• El representante legal, en caso de las personas morales mencionadas en este documento.

·        The legal representative, in the case of the companies mentioned in this document.

• Quien promueva a nombre de otro deberá acreditar que la representación le fue otorgada a más tardar en la fecha en que se presente la promoción.

·        He who imports in the name of another must verify that the representation was granted no later than the date in which the process was initiated.

¿Cuántos vehículos de este tipo se pueden importar?

How many vehicles of this type can be imported?

• Sólo un vehículo cada cuatro años, tratándose de personas con discapacidad.

·        Only one vehicle every four years, with respect to person with a handicap.

• Hasta tres vehículos cada cuatro años, para el caso de personas morales de las que se señalan en este documento.

·        Up to three vehicles every four years, for the case of those companies stipulated in this document.

Personas físicas

Individuals

Presentar ante la Administración Local Jurídica que corresponda a su domicilio fiscal una solicitud por escrito en la que se cumpla con los siguientes requisitos:

Present before the Local Judicial Administration that corresponds to their fiscal address in writing in which the following requirements are complied with:

• Acreditar la discapacidad mediante la constancia expedida por alguna institución de salud con autorización oficial. (anexar copia de la constancia)

·        Verify the handicap through the Certificate issued by any health institution with official authorization. (Attach a copy of this certificate)

• Anexar la descripción detallada de las adaptaciones realizadas al vehículo o de las características que lo hacen especial (incluso fotografías).

·        Attach the detailed description of the adaptations made to the vehicle or the characteristics that make it special (include photographs).

• Anexar copia simple del título de propiedad en donde conste la descripción detallada del vehículo (marca, año, modelo y número de serie)

·        Attach a simple copy of the property title where it verifies the detailed description of the vehicle (make, year, model, and serial number)

• El escrito debe cumplir con todos los requisitos que se establecen en los artículos 18, 18-A y en su caso 19 del Código Fiscal de la Federación.

·        The written document must comply with all the requirements that are established in articles 18, 18-A and when applicable 19 of the Fiscal Code of the Federation.

• Anexar copia de la solicitud del permiso de importación definitiva presentado ante la Secretaría de Economía.

·        Attach a copy of the permit application of permanent importation presented before the Secretary of Economy.

Personas morales

Companies

Presentar ante las administraciones correspondientes a la circunscripción territorial de su domicilio, una solicitud por escrito en la que se cumpla con los siguientes requisitos:

Present to the corresponding administrations according to the territorial jurisdiction of their address a request in writing in which the following requirements are complied with:

• Su denominación o razón social debe estar publicada en el anexo 14 de la resolución miscelánea fiscal vigente.

·        Their company name or corporate status must be published in the Annex 14 of the current fiscal miscellaneous resolution.

• Anexar la descripción detallada de las adaptaciones realizadas al vehículo o de las características que lo hacen especial (incluso fotografías).

·        Attach the detailed description of the adaptations made to the vehicle or of the characteristics that make it special (including photographs).

• Anexar copia del título de propiedad en donde conste la descripción detallada del vehículo (marca, año, modelo y número de serie).

·        Attach a copy of the property title where the detailed description of the vehicle is verified (make, year, model, and serial number).

• Anexar copia de la escritura constitutiva.

·        Attach a copy of the Corporation document.

• Anexar copia de la solicitud del permiso de importación definitiva presentado ante la Secretaría de Economía.

·        Attach a copy of the request for the permanent importation permit presented before the Secretary of Economy.

• El escrito debe cumplir con todos los requisitos que se establecen en los artículos 18 ,18-A y 19 del Código Fiscal de la Federación.

·        The written document must comply with all the requirements that are established in articles 18, 18-A, and 19 of the Fiscal Code of the Federation.

Sí, pero sólo después de cuatro años de haberlo importado.

• Para tener derecho a dicha exención, el vehículo invariablemente deberá encontrarse fuera del territorio nacional.

·        In order to have right to said exemption, the vehicle always must always be located outside the national territory.

• La entrada en territorio nacional de vehículos especiales o adaptados a que se refiere el presente documento requiere el cumplimiento de ciertos actos o formalidades, entre los que se encuentran la utilización del pedimento de importación y su presentación ante la aduana por conducto de agente o apoderado aduanal.

·        The entry into national territory of special or adapted vehicles referred to in this document requires the compliance to certain acts or formalities, among which are is the utilization of the “pedimento” of importation and its presentation before Customs by a customs broker or broker agent.

• El vehículo deberá utilizarse exclusiva y permanentemente por las personas referidas en este documento.

·        The vehicle must be utilized exclusively and permanently by the persons referred to in this document.

No se considerará que los vehículos importados en definitiva se destinan a propósitos distintos a los que motivaron el beneficio de la exención, por el hecho de que la persona con discapacidad no se encuentre a bordo del vehículo, siempre que se conserve en el vehículo las copias del pedimento de importación definitiva, del permiso otorgado por la SE y no se hubiera retirado del vehículo el dispositivo que se hubiera instalado para el uso personal o transporte de personas con discapacidad.

It will not be considered that the permanently imported vehicles are designated for purposes distinct from those that motivated the benefit of the exemption, by the situation that the handicapped person is not found on board the vehicle, provided that the copies of the “pedimento” of permanent importation are kept in the vehicle, the permit granted by the SE and that the device was not removed from the vehicle that was installed for the personal use or transport of handicapped persons.

• La autorización que al respecto expida la autoridad competente queda condicionada a que los solicitantes cumplan con las obligaciones en materia de regulaciones y restricciones no arancelarias para su importación.

·        The authorization that for the purpose is issued by the authority with jurisdiction remains conditioned on the compliance by the applicants with the non tariff regulations and restrictions for its importation.

• La venta del o los vehículos a que se refiere este documento nunca tendrá por objeto desvirtuar el fin para el cual se importaron al país.

·        The sale of the vehicle or vehicles referred to in this document never will have the purpose of diverting them from the purpose for which they were imported into the country.

Finalmente, el 24 de febrero de 2005 se publicó en el Diario Oficial de la Federación el “Acuerdo por el que se dan a conocer los criterios para emitir permisos de importación de vehículos usados que según sus características son necesarios para que ciertos sectores de la población desarrollen sus actividades productivas y/o socioeconómicas”, en el artículo 4 se las características del tipo de vehículo adaptado que podrá importarse para cada tipo de discapacidad.

Finally, on the 24^th of February of 2005, there was published in the Official Daily of the Federation the “Agreement by which is made know the criteria for issuing permits of importation of used vehicles that according to their characteristics are necessary so that certain sectors of the population perform their productive and/or socioeconomic activities”, in article 4 are located the characteristics of the type of vehicle adapted that can be imported for each type of handicap.
