ELEVENTH TRANSITIONAL ARTICLE

Décimo Primero. Legitimación de Contratos Colectivos de Trabajo. Con el fin de cumplir el mandato del artículo 123, apartado A, fracción XVIII, segundo párrafo y XX Bis de la Constitución y los compromisos internacionales asumidos por el Estado mexicano, los contratos colectivos de trabajo existentes deberán revisarse al menos una vez durante los cuatro años posteriores a la entrada en vigor de este Decreto.

Eleventh. Legitimization of Collective Labor Contracts. In order to fulfill the mandate of article 123, section A, section XVIII, second paragraph and XX Bis of the Constitution and the international commitments assumed by the Mexican State, existing collective bargaining contracts must be reviewed at least once during the four years after the entry into force of this Decree.

Las referidas revisiones contractuales deberán depositarse ante el Centro Federal de Conciliación y Registro Laboral. Dicho Centro verificará que se haya hecho del conocimiento de los trabajadores el contenido del contrato colectivo de trabajo y que se les entregó un ejemplar impreso del mismo por parte del patrón; asimismo, que éste contrato cuenta con el respaldo de la mayoría de los trabajadores mediante voto personal, libre y secreto.

The aforementioned contractual revisions must be deposited with the Federal Conciliation and Labor Registration Center. Said Center will verify that the contents of the collective labor contract have been made known to the workers and that they were given a printed copy of it by the employer; likewise, that this contract has the support of the majority of workers by personal, free and secret vote.

La consulta a los trabajadores se realizará conforme al procedimiento establecido en el artículo 390 Ter de esta Ley.

The workers will be consulted in accordance with the procedure established in article 390 Ter of this Law.

Si al término del plazo fijado en el primer párrafo de este artículo el contrato colectivo de trabajo sujeto a consulta no cuenta con el apoyo mayoritario de los trabajadores o se omite realizar la consulta mencionada, éste se tendrá por terminado, conservándose en beneficio de los trabajadores las prestaciones y condiciones de trabajo contempladas en el contrato colectivo sujeto a revisión, que sean superiores a las establecidas en esta Ley, las que serán de aplicación obligatoria para el patrón.

If, at the end of the term established in the first paragraph of this article, the collective labor contract subject to consultation does not have the majority support of the workers or the mentioned consultation is omitted, it will be considered finished, remaining for the benefit of the workers the benefits and working conditions contemplated in the collective contract subject to revision, which are superior to those established in this Law, which will be of obligatory application for the employer.

Hasta en tanto no entre en funciones el Centro Federal de Conciliación y Registro Laboral, la Secretaría del Trabajo y Previsión Social establecerá el protocolo para efectuar la verificación de la consulta a que se refiere el presente artículo transitorio y dispondrá las medidas necesarias para su instrumentación, dentro de un plazo de tres meses siguientes a la entrada en vigor del presente Decreto. La Junta Federal  de Conciliación y Arbitraje tendrá la participación que dicho protocolo le establezca.

Until the Federal Center for Conciliation and Labor Registration becomes operational, the Secretary of Labor and Social Welfare will establish the protocol to carry out the verification of the consultation referred to in this transitory article and will arrange the necessary measures for its implementation, within a period of three months following the entry into force of this Decree. The Federal Conciliation and Arbitration Board will have the participation that said protocol establishes.
