V.         Dar plena autonomía a los médicos que presten estos servicios para certificar la capacidad de los trabajadores, a efecto de que reanuden sus labores, y emitir opinión sobre el grado de incapacidad, y

The analysis referred to in the preceding Section I, can be accredited through the environmental risk study that was presented according to the provision in article 147 of the General Law of Ecological Equilibrium and Protection of the Environment and, when applicable, the program for the prevention of accidents, approved under the terms stipulated in said ordinance.

Artículo 76. Los patrones deberán dar aviso a la Secretaría, por escrito o en forma electrónica, de los Accidentes de Trabajo que ocurran dentro de las 72 horas siguientes, conforme a lo que establece el artículo 504, fracción V de la Ley.

Dicho aviso podrá ser realizado por el trabajador ante la institución pública de seguridad social a la cual estuviera afiliado, o por sus familiares, si el trabajador se encuentra incapacitado para efectuarlo, en caso de que el patrón no lo realice dentro del término antes indicado. Asimismo, el trabajador o sus familiares podrán dar el aviso a que se refiere el párrafo anterior, a la Secretaría en los términos y condiciones previstos en la normativa correspondiente.

Las instituciones públicas de seguridad social deberán informar en forma electrónica a la Secretaría sobre los avisos de Accidentes de Trabajo que presenten los patrones o, en su caso, los trabajadores o sus familiares, en los términos y condiciones previstos en la normativa correspondiente.

Los patrones quedarán relevados de dar dicho aviso a la Secretaría, cuando lo presenten ante la institución pública de seguridad social a la que por disposición de ley estuviere afiliado el trabajador, dentro del término a que se refiere el párrafo anterior.

Article 76. Employers must notify the Secretary, in writing or electronically, on the Work Accidents that occur within the following 72 hours, according to that established in article 504, section V of the Law. (Federal Labor Law)

Said notification must be made by the worker to the public institution of social security to which he was affiliated or by his family members, if the worker is found to be incapacitated to do so, when the employer does not do so within the term previously indicated. In addition, the worker or their family members can make the notification referred to in the preceding paragraph, to the Secretary and under the terms and conditions detailed in the corresponding legislation.

The public institutions of social security (IMSS) must inform the Secretary electronically of the notices of Work Accidents presented by the employers or, when applicable, the workers or their family members, under the terms and conditions detailed in the corresponding legislation. 

The employers will remain relieved from notifying the Secretary when they present it to the public institution of social security to which by provision of the law the worker was affiliated, within the term referred to in the preceding paragraph.

Article 27. For the operation of containers subject to pressure, cryogenic containers and steam generators or boilers that are determined in the Standard, the employers must give written notice to the Secretary before the date they are placed into operation, that said equipment complies with the safety conditions stipulated, together with the certificate of Evaluation of Conformity issued by a Unit of Verification accredited and approved, according to the methods provided in the respective Standard. 

With regard to new equipment, the employers must give notice that they comply with the safety conditions, together with the certificate of Evaluation of Conformity corresponding to the ten years after the execution of the first one, and then every five years with the sixty calendar days prior to the conclusion of each period.

In the case of used equipment, the employers must give notice that they comply with the safety conditions, together with the respective certificate of Evaluation of Conformity five years after the first, and then each five years, within the sixty calendar days after the conclusion of each period.

Article 27. XI.        Tener lugares higiénicos para el consumo de alimentos, en su caso;

XII.       Mantener con orden y limpieza permanentes las áreas de trabajo y los pasillos exteriores a los edificios, estacionamientos y otras áreas comunes del Centro de Trabajo;

I. Construct them according to the regulatory provisions in matters of construction and the pertinent Standards;

II. Assure that they support the stationary or mobile loads that correspond to the activities carried out in them; 

III. Make available safe and delimited spaces in the zones for production, maintenance, circulation of persons and vehicles, warehousing and services for the workers;

V. Provide adequate natural or artificial ventilation;

VIII. Make available to the workers drinking water and disposable cups or drinking fountains;

IX. Install restrooms for women and men, and clean and safe sinks for the service of the workers;

X. Have showers and dressing rooms, according to the activities that are carried out or when required, the decontamination of workers;

XI. Have hygienic places for the consumption of foodstuffs, when applicable;

XII. Maintain the work areas and the exterior passageways of the buildings, parking lots and other common areas of the Workplace permanently orderly and clean;

II.         Contar con los medios de detección y equipos contra incendio, así como con sistemas fijos de protección y alarmas de incendio, de conformidad con lo que señala la Norma respectiva;

VIII.     Contar con un croquis, plano o mapa general del Centro de Trabajo, o por áreas que lo integran, que identifique al menos las principales áreas o zonas con Riesgo de incendio, la ubicación de los medios de detección de incendio y de los equipos y sistemas contra incendio, así como las rutas de evacuación;

IX.        Prohibir y evitar el bloqueo, daño, inutilización o uso inadecuado de los equipos y sistemas contra incendio, el Equipo de Protección Personal para la respuesta a emergencias, así como los señalamientos de evacuación, prevención y de equipos y sistemas contra incendio;

X.         Adoptar medidas de seguridad para prevenir la generación y acumulación de electricidad estática en las áreas donde se manejen sustancias inflamables o explosivas;

XII.       Disponer de rutas de evacuación que cumplan con las medidas de seguridad dispuestas por la Norma de la especialidad;

XIII.     Contar con brigadas contra incendio en los Centros de Trabajo, cuando así lo exija la Norma aplicable;

XIV.      Desarrollar simulacros de emergencias de incendio;

II. Have the means for fire detection and firefighting equipment, as well as stationary systems for fire protection and fire alarms, according to that stipulated in the respective Standard;

VIII. Have a diagram, plan or general map of the Workplace, or by the areas that make it up, that identifies at least the principal areas or zones with Risk of Fire, the location of the means for the detection of fires and the firefighting equipment and systems, as well as the evacuation routes;

IX. Prohibit and avoid blocking, damage, or misuse or inadequate use of the firefighting equipment, the Personal Protective Equipment for the response to emergencies, as well as the signs for evacuation, prevention, and firefighting equipment and systems;  

X. Adopt safety measures for preventing the generation and accumulation of static electricity in the areas where flammable or explosive substances are handled;

XII. Make available evacuation routes that comply with the safety measures described in the Standard for that specialty;

XIII. Have firefighting brigades in Workplaces, when the applicable standard requires it;

XIV. Carry out emergency fire drills;

III.       Disponer de un código de señales o sistema de comunicación para los operadores y ayudantes involucrados en el manejo y transporte de materiales con maquinaria o equipo de elevación;

IV.        Dotar a la maquinaria y equipos con dispositivos de paro de seguridad, avisos sobre su capacidad máxima de carga y señalización audible y visible;

V.         Verificar las condiciones de seguridad de la maquinaria y equipos que se destinen a tales fines, antes de ponerse en servicio;

VI.        Supervisar que el manejo, transporte y almacenamiento de materiales se realice en condiciones seguras;

VII.       Mantener las áreas de trabajo libres de obstáculos;

III. Make available a code of signals or communication system for the operators and helpers involved in the handling and transport of materials with machinery or elevating equipment;

IV. Provide the machinery and equipment with safety stop devices, warnings on their maximum load capacity and audible and visible signals;

V. Verify the safety conditions of the machinery and equipment that are designated for such purposes, before placing them into service;

VI. Supervise that the handling, transport and storage of materials is done under safe conditions;

IV.        Identificar los recipientes que las contengan y mantenerlos cerrados mientras no se utilizan;

V.         Almacenar las Sustancias Químicas Peligrosas en recipientes específicos, de materiales compatibles con la sustancia de que se trate;

VI.        Identificar las tuberías que conduzcan Sustancias Químicas Peligrosas, y contar con dispositivos que permitan interrumpir el flujo;

VII.       Disponer de zonas específicas para su almacenamiento;

VIII.     Contar con instalaciones de materiales resistentes al fuego en áreas donde su manejo, transporte o almacenamiento representa Riesgo de incendio o explosión;

IX.        Disponer de instalaciones, equipo o materiales para contener las Sustancias Químicas Peligrosas, que impidan su escurrimiento o dispersión, en el caso de derrame o fuga;

X.         Aislar las áreas destinadas para el almacenamiento de sustancias inflamables o explosivas de cualquier fuente de calor o ignición;

XI.        Realizar el trasvase de sustancias inflamables o explosivas con ventilación o aislamiento del proceso para evitar la presencia de atmósferas explosivas;

XIII.     Prohibir el uso de herramientas, ropa, zapatos y objetos personales que puedan generar chispa, flama abierta o temperaturas que puedan provocar ignición;

XIV.      Contar con regaderas y lavaojos, neutralizadores e inhibidores, en las zonas de Riesgo para la atención a emergencias;

XV.       Disponer de regaderas, vestidores y casilleros, así como de servicio de limpieza de ropa, cuando el depósito de Sustancias Químicas Peligrosas en la piel o ropa de los trabajadores pueda representar un Riesgo a su salud;

IV. Identify the containers that contain them and maintain them closed while they are not used;

V. Store the Hazardous Chemical Substances in specific containers, of materials compatible with the substance in question;

VI. Identify the pipes that conduct Hazardous Chemical Substances and have devices that permit interrupting their flow;

VII. Provide specific zones for their storage;

VIII. Have installations of materials resistant to fire in areas where their handling, transport or storage represent a Risk of fire or explosion;

IX. Provide installations, equipment or materials for containing Hazardous Chemical Substances that impede their runoff or dispersion, in the case of a spill or leak;

X. Isolate the areas designated for the storage of flammable substances or explosives from any source of heat or ignition;

XI. Carry out the transfer of flammable substances or explosives with ventilation or isolation from the process to avoid the presence of explosive atmospheres;

XIII. Prohibit the use of tools, clothing, shoes, and personal objects that can generate sparks, open flames or temperatures that can cause ignition;

XIV. Provide showers and eyewashes, neutralizers and inhibitors, in the zones of Risk for the attention to emergencies; 

XV. Provide showers, dressing rooms and lockers, as well as the clothes cleaning service, when the deposit of Hazardous Chemical Substances on the skin or clothing of the workers can represent a Risk to their health;
