Disposiciones Generales

General Provisions

Artículo 1. El presente Reglamento es de orden público e interés social y de observancia general en todo el territorio nacional.

Article 1. This Regulation is for public order and social interest and of general observance in the entire national territory.

Artículo 2. Este Reglamento tiene por objeto establecer las disposiciones en materia de Seguridad y Salud en el Trabajo que deberán observarse en los Centros de Trabajo, a efecto de contar con las condiciones que permitan prevenir Riesgos y, de esta manera, garantizar a los trabajadores el derecho a desempeñar sus actividades en entornos que aseguren su vida y salud, con base en lo que señala la Ley Federal del Trabajo.

Article 2. This Regulation has the object of establishing the provisions for Occupational Health and Safety that must be observed in Workplaces, for the purpose of assuring the existence of conditions that permit preventing Risks and, in this way, guaranteeing workers the right to perform their activities in environments that ensure their lives and health, based on all that stipulated in the Federal Labor Law.  

Artículo 3. Para los efectos del presente Reglamento se entenderá por:

Article 3. For the purposes of this Regulation, the following will be understood as:

I.          Accidente de Trabajo: Toda lesión orgánica o perturbación funcional, inmediata o posterior, o la muerte, producida repentinamente en ejercicio o con motivo del trabajo, cualesquiera que sean el lugar y el tiempo en que se preste;

I. Work accident: All organic injuries or physical dysfunction, immediate or subsequent, or death, produced suddenly during the exercise or for reason of work, whatever the place and the time where the work is rendered.

II.        Acciones Preventivas y Correctivas: Aquéllas que se establecen a partir del Diagnóstico de Seguridad y Salud en el Trabajo;

II. Preventive and corrective actions: Those that are established from the occupational health and safety diagnostic; 

III.       Autoridad Laboral: Las unidades administrativas competentes de la Secretaría que realizan funciones de inspección y vigilancia en materia de Seguridad y Salud en el Trabajo, y las correspondientes de las entidades federativas, que actúen en auxilio de aquéllas;

III. Labor authority: The appropriate administrative units of the Secretary that carry out functions of inspection and oversight in matters of occupational health and safety and those authorities corresponding to the Federal Entities (States and the Federal District), that act as auxiliaries to the Federal Authorities; 

IV.        Centro de Trabajo: El lugar o lugares, tales como edificios, locales, instalaciones y áreas, donde se realicen actividades de explotación, aprovechamiento, producción, comercialización, transporte y almacenamiento o prestación de servicios, en los que laboren personas que estén sujetas a una relación de trabajo;

IV. Workplace: All those places, such as buildings, locales, installations and areas, where activities of exploitation, utilization, production, commercial distribution, transport and warehousing, or the rendering of services are carried out, in those in which persons subject to a labor relation are working;

V.         Condiciones Inseguras: Aquéllas que derivan de la inobservancia o desatención de los procedimientos o medidas de seguridad dispuestos en este Reglamento y las Normas, y que pueden conllevar la ocurrencia de incidentes, Accidentes y Enfermedades de Trabajo o daños materiales al Centro de Trabajo;

V. Unsafe Conditions: Those that derive from the nonobservance or inattention to the procedures or safety measures established in this Regulation and the Standards, and that can lead to the occurrence of Occupational Incidents, Accidents and Illnesses or material damages to the Workplace;

VI.        Condiciones Peligrosas: Aquellas características inherentes a las instalaciones, procesos, maquinaria, equipo, herramientas y materiales, que pueden poner en Riesgo la salud, la integridad física o la vida de los trabajadores, o dañar las instalaciones del Centro de Trabajo;

VI. Hazardous Conditions: Those characteristics inherent to the installations, processes, machinery, equipment, tools and materials that can place at Risk the health, physical integrity or the life of workers or damage the installations of the Workplace;

VII.      Contaminantes del Ambiente Laboral: Los agentes físicos, químicos y biológicos capaces de modificar las condiciones ambientales del Centro de Trabajo, que por sus propiedades, concentración, nivel, así como tiempo de exposición o acción pueden alterar la salud del Personal Ocupacionalmente Expuesto;

VII. Contaminants in the Work Environment: The physical, chemical and biological agents capable of modifying the environmental conditions of the Workplace, that by their properties, concentration, level, as well as the exposure or action time can alter the health of Occupationally Exposed Personnel;

VIII.     Control: El proceso mediante el cual se instrumentan las medidas de seguridad, derivadas de la Evaluación de los agentes Contaminantes del Ambiente Laboral, a efecto de no rebasar los valores límite de exposición;

VIII. Control: The process through which the safety measures are implemented, derived from the Evaluation of the Contaminant Agents of the Work Environment, for the purpose of not exceeding the exposure limit values;

IX.        Diagnóstico de Seguridad y Salud en el Trabajo: La identificación de las Condiciones Inseguras o Peligrosas; de los agentes físicos, químicos o biológicos o de los Factores de Riesgo Ergonómico o Psicosocial capaces de modificar las condiciones del ambiente laboral; de los peligros circundantes al Centro de Trabajo, así como de los requerimientos normativos en materia de Seguridad y Salud en el Trabajo que resulten aplicables;

IX. Occupational Health and Safety Diagnostic: The identification of Unsafe or Hazardous Conditions; physical, chemical or biological agents or the Ergonomic or Psychosocial Risk Factors capable of modifying the conditions of the Work Environment; of the dangers surrounding the Workplace, as well as the legal requirements in matters of Occupational Health and Safety that are applicable;

X.         Enfermedad de Trabajo: Todo estado patológico derivado de la acción continuada de una causa que tenga su origen o motivo en el trabajo o en el medio en que el trabajador se vea obligado a prestar sus servicios;

X. Occupational Illness: All pathological states derived from the continued action of a cause that has its origin or cause in the work or in the media in which the worker is obligated to render his/her services;

XI.        Entorno Organizacional Favorable: Aquél en el que se promueve el sentido de pertenencia de los trabajadores a la organización; la formación para la adecuada realización de las tareas encomendadas; la definición precisa de responsabilidades para los miembros de la organización; la participación proactiva y comunicación entre sus integrantes; la distribución adecuada de cargas de trabajo, con jornadas laborales regulares, y la Evaluación y el Reconocimiento del desempeño;

XI. Favorable Organizational Environment: That in which a feeling of belonging to the organization among the workers; formation for the adequate performance of the tasks for which they are made responsible; the precise definition of responsibilities for the members of the organization; the proactive participation and communication among the members; the adequate distribution of work responsibilities, with regular labor shifts and the Evaluation and Review of performance is promoted;

XII.      Equipo de Protección Personal: El conjunto de elementos y dispositivos diseñados específicamente para proteger al trabajador contra Accidentes y Enfermedades de Trabajo;

XII. PERSONAL PROTECTIVE EQUIPMENT: The combination of elements and devices specifically designed to protect the worker from Occupational Accidents and Illnesses;

XIII.     Espacio Confinado: El lugar o lugares sin ventilación natural, en el que una o más personas puedan desempeñar una determinada tarea en su interior, con medios limitados o restringidos para su acceso o salida, que no están diseñados para ser ocupados en forma continua y en los cuales se realizan trabajos ocasionalmente;

XIII. Confined Space: The place or places without natural ventilation, in which one or more persons may perform a determined task in the interior, with limited or restricted means of access or exit, that are not designed for being occupied continuously and in which work is occasionally carried out;

XIV.      Evaluación: El proceso por medio del cual se efectúa el muestreo; la determinación analítica, tratándose de los agentes químicos Contaminantes del Ambiente Laboral, y la comparación de los resultados, conforme a los valores límite de exposición;

XIV. Evaluation: The process by which sampling and/or analytical determination is carried out with regard to the chemical contaminant agents of the Work Environment and the comparison of the results, according to the exposure limit values;  

XV.       Evaluación de la Conformidad: La determinación del grado de cumplimiento con las Normas;

XV. Evaluation of Conformity: The determination of the degree of compliance with the Standards;

XVI.      Factores de Riesgo Ergonómico: Aquéllos que pueden conllevar sobre esfuerzo físico, movimientos repetitivos o posturas forzadas en el trabajo desarrollado, con la consecuente fatiga, errores, Accidentes y Enfermedades de Trabajo, derivado del diseño de las instalaciones, maquinaria, equipo, herramientas o puesto de trabajo;

XVI. Ergonomic Risk Factors: Those that can imply physical stress, repetitive movements or forced postures in the work performed, with consequent fatigue, errors, Occupational Accidents and Illnesses, derived from the design of the installations, machinery, equipment, tools or job position;

XVII.    Factores de Riesgo Psicosocial: Aquéllos que pueden provocar trastornos de ansiedad, no orgánicos del ciclo sueño-vigilia y de estrés grave y de adaptación, derivado de la naturaleza de las funciones del puesto de trabajo, el tipo de jornada laboral y la exposición a acontecimientos traumáticos severos o a actos de Violencia Laboral, por el trabajo desarrollado;

XVII. Psychosocial Risk Factors: Those that can cause anxiety disorders, nonorganic disorders of the sleep-wake cycle and serious stress and adaptation disorders derived from the nature of the work position functions, the type of work shift and the exposure to severe traumatic events or acts of Labor Violence, from the work performed;

XVIII.   Ley: La Ley Federal del Trabajo;

XVIII. Law: The Federal Labor Law;

XIX.      Medidas de Control: Aquéllas de naturaleza técnica o administrativa que se adoptan para disminuir la exposición a los Contaminantes del Ambiente Laboral;

XIX. Control Measures: Those of a technical or administrative nature that are adopted for diminishing exposure to Contaminants in the Work Environment;

XX.       Norma: La norma o normas oficiales mexicanas de Seguridad y Salud en el Trabajo expedidas por la Secretaría, de acuerdo con lo que establecen la Ley Federal sobre Metrología y Normalización y su reglamento;

XX. Standard: The Official Mexican Standard or Standards for Occupational Health and Safety issued by the Secretary, according to that established in the Federal Law of Metrology and Standardization and its Regulation;  (NOM-STPS)

XXI.      Organismos Privados: Las unidades de verificación, los laboratorios de pruebas y los organismos de certificación, acreditados y aprobados en términos de la Ley Federal sobre Metrología y Normalización y su reglamento, que realizan actos de Evaluación de la Conformidad de las Normas;

XXI. Private Entities: The Units of Verification, the testing laboratories and the certification entities, accredited and approved under the terms of the Federal Law of Metrology and Standardization and its Regulation, that carry out acts of Evaluation of the Conformity to the Standards;

XXII.    Personal Ocupacionalmente Expuesto: Aquellos trabajadores que en ejercicio y con motivo de su ocupación están expuestos a Condiciones Inseguras o Peligrosas o a Contaminantes del Ambiente Laboral;

XXII. Occupationally Exposed Personnel: Those workers that during the exercise of and for reasons of their occupation are exposed to Unsafe or Hazardous Conditions or Contaminants in the Work Environment;

XXIII.   Programa de Seguridad y Salud en el Trabajo: El documento que contiene el conjunto de Acciones Preventivas y Correctivas por instrumentar para evitar Riesgos en los Centros de Trabajo, que puedan afectar la vida, la integridad física o la salud de los trabajadores o causar daños en sus instalaciones;

XXIII. Occupational Health and Safety Program: The document that contains the combination of Preventive and Corrective Actions to be implemented for avoiding Risks in the Workplace that can affect life, physical integrity or the health of the workers or cause damages in their installations;

XXIV.    Reconocimiento: El proceso mediante el cual se identifican los agentes Contaminantes del Ambiente Laboral; sus propiedades o características; las vías de ingreso al cuerpo humano; sus efectos en la salud; las fuentes emisoras de contaminantes; las áreas o zonas donde exista Riesgo a la exposición; los grupos de exposición homogénea, sus puestos y las actividades que desarrollan, así como los tiempos y frecuencias de exposición;

XXIV. Assessment: The process through which are identified the Contaminant agents of the Work Environment; their properties or characteristics; the routes of entry to the human body; their effects on health; the emission sources of contaminants; the areas or zones where Risk to exposure exists; the groups of homogenous exposure, their job positions and the activities that they carry out, as well as the times and frequencies of exposure;

XXV.     Riesgo: La correlación de la peligrosidad de uno o varios factores y la exposición de los trabajadores con la posibilidad de causar efectos adversos para su vida, integridad física o salud, o dañar al Centro de Trabajo;

XXV. Risk: The correlation of the hazards from one or several factors and the exposure of the workers with the possibility of causing adverse effects for their health, physical integrity or health or damaging the Workplace;

XXVI.    Riesgo Grave: Aquél que puede comprometer la vida, integridad física o salud de los trabajadores o producir daños a las instalaciones del Centro de Trabajo, al no observar los requisitos y condiciones de seguridad correspondientes;

XXVI. Serious Risk: That which compromise the life, physical integrity or health of workers or produces damages to the installations of the Workplace, when the corresponding requirements and safety conditions are not observed;

XXVII.  Secretaría: La Secretaría del Trabajo y Previsión Social;

XXVII. Secretary: The Secretary of Labor and Social Welfare;  (STPS)

XXVIII. Seguridad y Salud en el Trabajo: Todos aquellos aspectos relacionados con la prevención de Accidentes y Enfermedades de Trabajo, y que están referidos en otros ordenamientos a materias tales como: seguridad e higiene; seguridad e higiene industrial; seguridad y salud; seguridad, salud y medio ambiente de trabajo; seguridad, higiene y medio ambiente de trabajo;

XXVIII. Occupational Health and Safety: All those aspects related to the prevention of Occupational Accidents and Illnesses, and that are referred to in other ordinances on subjects such as: safety and hygiene;  industrial health and safety; health and safety; occupational health, safety and environment; occupational hygiene, safety and environment;

XXIX.    Servicios Preventivos de Medicina del Trabajo: Aquéllos prestados por un médico o bajo la supervisión de éste, preferentemente capacitado en medicina del trabajo, de manera interna o externa, cuyo propósito principal es participar en la prevención de Accidentes y Enfermedades de Trabajo, proporcionar atención médica y los primeros auxilios en los Centros de Trabajo, así como orientar y capacitar a los trabajadores sobre la prevención y promoción de la salud. Se entiende por internos, los prestados por personal del Centro de Trabajo, y externos, los proporcionados a través de instituciones públicas de seguridad social;

XXIX. Preventive Services of Occupational Medicine: Those rendered by a doctor or under his/her supervision, preferably trained in occupational medicine, internally or externally, whose principal purpose is to participate in the prevention of Occupational Accidents and Illnesses, to provide medical attention and first aid in Workplaces, as well as to orientate and train the workers on the prevention and promotion of health. Internal services are understood as those rendered by personnel from the Workplace, and external services as those provided through public social security institutions;  (IMSS – Mexican Institute of Social Security)

XXX.     Servicios Preventivos de Seguridad y Salud en el Trabajo: Aquéllos prestados por personal capacitado, ya sea interno, externo o mixto, cuyo propósito principal es prevenir los Accidentes y Enfermedades de Trabajo, mediante el cumplimiento de la normativa en materia de Seguridad y Salud en el Trabajo. Se entiende por internos, los proporcionados por el patrón o personal del Centro de Trabajo; externos, los prestados por personal independiente al Centro de Trabajo, y mixtos, los proporcionados tanto por personal interno como por personal independiente al Centro de Trabajo;

XXX. Preventive Services of Occupational Health and Safety: Those rendered by trained personnel, whether internal, external or mixed, whose principal purpose is to prevent Occupational Accidents and Illnesses, through compliance to the regulatory instruments in matters of Occupational Health and Safety. Internal services are understood as those provided by the employer or personnel of the Workplace; external services as those rendered by personnel independent from Workplace, and mixed are those provided by internal personnel as well as personnel independent of the Workplace;

XXXI.    Sistemas de Administración en Seguridad y Salud en el Trabajo: Aquéllos por medio de los cuales se impulsa la mejora continua en la prevención de los Accidentes y Enfermedades de Trabajo, mediante la autoevaluación del cumplimiento de las Normas;

XXXI. Administration systems in Occupational Health and Safety: Those systems by means of which continuous improvement is promoted for the prevention of Occupational Accidents and Illnesses, through self-evaluation of compliance to the Standards;

XXXII.  Sustancias Químicas Peligrosas: Aquéllas que por sus propiedades físicas y químicas al ser manejadas, transportadas, almacenadas o procesadas, presentan la posibilidad de Riesgos de explosividad, inflamabilidad, combustibilidad, reactividad, corrosividad, radiactividad, toxicidad o irritabilidad, y que al ingresar al organismo por vía respiratoria, cutánea o digestiva, pueden provocar intoxicación, quemaduras o lesiones orgánicas al Personal Ocupacionalmente Expuesto, según la concentración y el tiempo de exposición;

XXXII. Hazardous Chemical Substances: Those that by their physical and chemical properties when handled, transported, stored or processed, present the possibility of Risks of explosion, flammability, combustibility, reactivity, corrosiveness, radioactivity, toxicity or irritation, and that upon entry to the organism by respiratory, cutaneous, or digestive routes can cause intoxication, burns or organic injuries to the Occupationally Exposed Personnel, according to the concentration and exposure time;

XXXIII. Trabajadores con Discapacidad: Aquéllos que, por razón congénita o adquirida, presentan una o más deficiencias de carácter físico, mental, intelectual o sensorial, ya sea de naturaleza permanente o temporal;

XXXIII. Workers with Disability: Those that, for congenital reasons or by acquisition, present one or more deficiencies of a physical, mental, intellectual or sensorial character, whether of a permanent or temporary nature;

XXXIV.  Trabajadores del Campo: Aquéllos que ejecutan de manera permanente, eventual o estacional, las labores propias de las explotaciones agrícolas, ganaderas, acuícolas, forestales o mixtas, al servicio de un patrón, y

XXXIV. Field Workers: Those that execute permanently, periodically or seasonally, the work involving agricultural, ranching, aquaculture, forest or mixed holdings, in the service of an employer, and

XXXV.   Violencia Laboral: Aquellos actos de hostigamiento, acoso o malos tratos en contra del trabajador, que pueden dañar su integridad o salud.

XXXV. Labor Violence: Those acts of harassment, sexual harassment or bad treatment of the worker that can damage his/her integrity or health.

Second Chapter

Competencias

Responsibilities

Artículo 4. La aplicación del presente Reglamento corresponde a la Secretaría, quien se auxiliará por las Autoridades Laborales de las entidades federativas, cuando se trate de ramas o actividades de jurisdicción local, en los términos de la Ley.

Article 4. The application of this Regulation is the responsibility of the Secretary, who will aid the Labor Authorities of the Federal Entities (States and the Federal District) with regard to branches (industrial, commercial or services) or activities under state jurisdiction, under the terms of the Law.

La interpretación para efectos administrativos de este Reglamento y de las Normas que de él emanen, compete a la Secretaría.

The interpretation for administrative purposes of this Regulation and the Standards that are issued from it, is  the responsibility of the Secretary.

Artículo 5. La Secretaría, en materia de Seguridad y Salud en el Trabajo, tiene las atribuciones siguientes:

Article 5. The Secretary, in matters of Occupational Health and Safety, has the following duties:

I.          Formular la política pública de Seguridad y Salud en el Trabajo;

I. To formulate public policy for Occupational Health and Safety;

II.        Diseñar, coordinar, ejecutar y evaluar programas y campañas para la prevención de Accidentes y Enfermedades de Trabajo, con la participación de las dependencias e instituciones públicas que correspondan;

II. To design, coordinate, execute and evaluate programs and campaigns for the prevention of Occupational Accidents and Illnesses, with the participation of the corresponding public departments and institutions;

III.       Emitir las Normas con sus procedimientos para la Evaluación de la Conformidad;

III. To issue the Standards with their procedures for the Evaluation of Conformity;

IV.        Difundir la normativa en materia de Seguridad y Salud en el Trabajo y promover su cumplimiento;

IV. To disseminate the standards in matters of Occupational Health and Safety and promote their compliance;

V.         Promover la constitución y funcionamiento de las Comisiones de Seguridad e Higiene, de los Servicios Preventivos de Seguridad y Salud en el Trabajo, así como de los Servicios Preventivos de Medicina del Trabajo;

V. To promote the constitution and functioning of the Health and Safety Commissions, of the Preventive Services of Occupational Health and Safety, as well as the Preventive Services of Occupational Medicine;

VI.        Presidir y coordinar la Comisión Consultiva Nacional de Seguridad y Salud en el Trabajo y el Comité Consultivo Nacional de Normalización de Seguridad y Salud en el Trabajo;

VI. To preside over and coordinate the National Consultative Committee of Occupational Health and Safety and the National Consultative Committee of Standardization of Occupational Health and Safety;

VII.      Diseñar, promover y supervisar los mecanismos de autoevaluación del cumplimiento de las Normas;

VII. To design, promote and supervise the mechanisms of self-evaluation of compliance to Standards;

VIII.     Emitir reconocimientos a empresas que comprueben el cumplimiento de la normativa y de sus Programas de Seguridad y Salud en el Trabajo, así como el adecuado funcionamiento de sus Sistemas de Administración en Seguridad y Salud en el Trabajo;

VIII. To issue recognition to companies that verify compliance to the Standards and their Programs of Occupational Health and Safety, as well as the adequate functioning of their Systems of Administration for Occupational Health and Safety;

IX.        Promover la creación y, cuando proceda, aprobar a Organismos Privados;

IX. To promote the creation and, when applicable,  approve Private Entities; (third party services)

X.         Dar seguimiento al funcionamiento de Organismos Privados, al igual que reconocer los dictámenes, informes o certificados de cumplimiento que emitan;

X. To follow up on the functioning of Private Entities, and in addition to recognizing the official Verifications, reports or certificates of compliance that they issue;

XI.        Suspender o revocar las aprobaciones que hayan sido expedidas a Organismos Privados, y solicitar, en su caso, la suspensión o cancelación de la acreditación de los mismos;

XI. To suspend or revoke the approvals that have been issued to Private Entities and request, when applicable, the suspension or cancelation of the accreditation of the same;

XII.      Resolver las solicitudes de autorización para utilizar tecnologías, procesos, equipos, procedimientos, mecanismos, métodos de prueba o materiales alternativos a los previstos en las Normas, de conformidad con lo que determina la Ley Federal sobre Metrología y Normalización;

XII. To resolve the requests for authorization for using alternative technologies, processes, equipment, procedures, mechanisms, test methods or materials to those detailed in the Standards, according to that determined by the Federal Law of Metrology and Standardization;

XIII.     Actualizar las tablas de Enfermedades de Trabajo y de valuación de incapacidades permanentes a que se refiere la Ley, previa opinión de la Comisión Consultiva Nacional de Seguridad y Salud en el Trabajo;

XIII. To update the tables of Occupational Illnesses and the valuation of permanent disabilities referred to in the Law, after opinion of the National Consultative Committee of Occupational Health and Safety;

XIV.      Suscribir convenios de colaboración con las dependencias y entidades de la Administración Pública Federal y de coordinación con los gobiernos de las entidades federativas, en materia de Seguridad y Salud en el Trabajo;

XIV. To sign conventions of collaboration with the departments and entities of the Federal Public Administration and of coordination with the governments of the Federal Entities (States and the Federal District) in matters of Occupational Health and Safety;

XV.       Suscribir convenios de concertación con las organizaciones de trabajadores y de patrones, a efecto de instrumentar programas y campañas en materia de prevención de Accidentes y Enfermedades de Trabajo;

XV. To sign coordination conventions with workers and employers organizations, for the purpose of implementing programs and campaigns in matters of prevention of Occupational Accidents and Illnesses;

XVI.      Suscribir convenios de cooperación científica y técnica en materia de Seguridad y Salud en el Trabajo con instituciones nacionales e internacionales;

XVI. To sign conventions for scientific and technical cooperation in matters of Occupational Health and Safety with national and international institutions;

XVII.    Suscribir convenios de colaboración académica en materia de Seguridad y Salud en el Trabajo con instituciones educativas;

XVII. To sign conventions of academic collaboration in matters of Occupational Health and Safety with educational institutions;

XVIII.   Vigilar el cumplimiento de las disposiciones en materia de Seguridad y Salud en el Trabajo contenidas en el presente Reglamento y en las Normas;

XVIII. To oversee compliance to the provisions in matters of Occupational Health and Safety contained in this Regulation and in the Standards;

XIX.      Instaurar, sustanciar y resolver el procedimiento administrativo para el cumplimiento de disposiciones en materia de Seguridad y Salud en el Trabajo contenidas en este Reglamento y en las Normas y, en caso de violación a dichas disposiciones, aplicar las sanciones correspondientes;

XIX. To install, substantiate, and resolve the administrative procedure for the compliance to the provisions in matters of Occupational Health and Safety contained in this Regulation and in the Standards and, in the case of violations to said provisions, apply the corresponding sanctions;

XX.       Tramitar y resolver los recursos administrativos que le correspondan y sustanciar los relativos a las resoluciones mediante las cuales se impongan sanciones por violaciones a las disposiciones en materia de Seguridad y Salud en el Trabajo, y

XX. To process and resolve the administrative resources that correspond and substantiate those related to the resolutions through which sanctions are imposed for violations to the provisions in matters of Occupational Health and Safety, and

XXI.      Las demás que le señalen otras disposiciones legales o reglamentarias, y que estén en el ámbito de su competencia.

XXI. All those stipulated by other legal or regulatory provisions and that are within the scope of their jurisdiction.  (STPS)

Artículo 6. Las acciones que en materia de Seguridad y Salud en el Trabajo lleve a cabo la Secretaría se complementarán con las que desarrollen las Secretarías de Gobernación; de Salud; de Medio Ambiente y Recursos Naturales; de Energía; de Economía; de Comunicaciones y Transportes, y el Instituto Mexicano del Seguro Social, conforme al ámbito de sus respectivas competencias y de las disposiciones jurídicas aplicables.

Article 6. The actions that in matters of Occupational Health and Safety are carried out by the Secretary will be complemented with those carried out by the Secretaries of Government (SEGOB); Health (SALUD); Environment (SEMARNAT); Energy (SECRE); Economy (SE); Communications and Transportation (SCT), according to the scope of their respective authority and the applicable legal provisions.

Artículo 7. Son obligaciones de los patrones:

Article 7. The following are obligations of the Employers:

I.          Contar con un Diagnóstico de Seguridad y Salud en el Trabajo y los estudios y análisis de Riesgos requeridos por el presente Reglamento y las Normas, que forman parte del referido diagnóstico;

I. To have an Occupational Health and Safety Diagnostic and the studies and analysis of Risks required by this Regulation and the Standards that form part of the aforesaid diagnostic;

II.        Integrar un Programa de Seguridad y Salud en el Trabajo, con base en el Diagnóstico de Seguridad y Salud en el Trabajo;

II. To integrate an Occupational Health and Safety Program based on the Occupational Health and Safety Diagnostic;

III.       Elaborar los programas específicos, manuales y procedimientos, que orienten la realización de las actividades y procesos laborales bajo condiciones seguras y de emergencia;

III. To prepare the specific programs, manuals and procedures that orientate the performance of labor activities and processes under safe and emergency conditions;

IV.        Constituir e integrar la Comisión de Seguridad e Higiene, así como dar facilidades para su operación;

IV. To constitute and integrate the Health and Safety Commission, as well as to facilitate its operation;

V.         Garantizar la prestación de los Servicios Preventivos de Seguridad y Salud en el Trabajo y, en los términos de la Ley, los de medicina del trabajo;

V. To guarantee the rendering of the Preventive Services of Occupational Health and Safety and, under the terms of the Law, those of occupational medicine;

VI.        Colocar en lugares visibles del Centro de Trabajo los avisos o señales para informar, advertir y prevenir Riesgos;

VI. To place in visible places of the Workplace, the warnings or signs and colors for informing, warning and preventing Risks;

VII.      Aplicar, en la instalación de sus establecimientos, las medidas de Seguridad y Salud en el Trabajo señaladas en este Reglamento y en las Normas, conforme a la naturaleza de las actividades y procesos laborales;

VII. To apply, in the installation of their establishments, the Occupational Health and Safety measures stipulated in this Regulation and in the Standards, according to the nature of the activities and labor processes;

VIII.     Llevar a cabo las acciones de Reconocimiento, Evaluación y Control de los Contaminantes del Ambiente Laboral, a efecto de conservar las condiciones ambientales del Centro de Trabajo dentro de los valores límite de exposición;

VIII. To carry out the actions of Assessment, Evaluation and Control of the Contaminants of the Work Environment, for the purpose of conserving the environmental conditions of the Workplace within the exposure limit values;

IX.        Ordenar la aplicación de exámenes médicos al Personal Ocupacionalmente Expuesto, requeridos por el presente Reglamento y las Normas;

IX. To order the application of medical examinations for the Occupationally Exposed Personnel required by this Regulation and the Standards;

X.         Proporcionar a los trabajadores el Equipo de Protección Personal, de acuerdo con los Riesgos a que están expuestos;

X. To provide the workers with the Personal Protective Equipment according to the Risks to which they are exposed;

XI.        Informar a los trabajadores respecto de los Riesgos relacionados con la actividad que desarrollen;

XI. To inform the workers with respect to the Risks related to the activity they are carrying out;

XII.      Capacitar y adiestrar a los trabajadores sobre la prevención de Riesgos y la atención a emergencias, de conformidad con las actividades que desarrollen;

XII. To qualify and train the workers on the prevention of Risks and the attention to emergencies, according to the activities that they carry out;

XIII.     Capacitar al personal del Centro de Trabajo que forme parte de la Comisión de Seguridad e Higiene y de los Servicios Preventivos de Seguridad y Salud en el Trabajo y, en su caso, apoyar la actualización de los responsables de los Servicios Preventivos de Medicina del Trabajo de carácter interno;

XIII. To qualify the personnel of the Workplace that forms part of the Health and Safety Commission and the Preventive Services of Occupational Health and Safety and, when applicable, to support the updating of the persons responsible for the internal Preventive Services of Occupational Medicine;

XIV.      Expedir las autorizaciones para la realización de actividades o trabajos peligrosos que prevén este Reglamento y las Normas específicas;

XIV. To issue the authorizations for the performance of hazardous activities or tasks that are detailed in this Regulation and the specific Standards;

XV.       Llevar los registros administrativos, por medios impresos o electrónicos, establecidos en el presente Reglamento y las Normas;

XV. To maintain the administrative records, printed or electronic, established in this Regulation and the Standards;

XVI.      Dar aviso a la Secretaría, a través de las Delegaciones Federales del Trabajo, la Dirección General de Inspección Federal del Trabajo o la Dirección General de Investigación y Estadísticas del Trabajo, o a las instituciones de seguridad social sobre los Accidentes de Trabajo que ocurran;

XVI. To give notice to the Secretary, through the Federal Labor Delegations, the General Office of Federal Labor Inspection or the General Office of Occupational Investigation and Statistics, or the social security institutions on the Labor Accidents that may occur;

XVII.    Dar aviso a la Secretaría, a través de las Delegaciones Federales del Trabajo, la Dirección General de Inspección Federal del Trabajo o la Dirección General de Investigación y Estadísticas del Trabajo,  sobre las defunciones que ocurran con motivo de Accidentes y Enfermedades de Trabajo;

XVII. To give notice to the Secretary, through the Federal Labor Delegations, the General Office of Federal Labor Inspection or the General Office of Occupational Investigation and Statistics, on the deaths that occur for reason of Occupational Accidents and Illnesses;

XVIII.   Presentar los avisos relacionados con el funcionamiento de recipientes sujetos a presión, recipientes criogénicos y generadores de vapor o calderas, que contempla este Reglamento;

XVIII. To present the notices related to the functioning of containers subject to pressure, cryogenic containers and steam generators or boilers, that are included in this Regulation;

XIX.      Contar con los dictámenes, informes de resultados y certificados de cumplimiento en materia de Seguridad y Salud en el Trabajo, determinados en el presente Reglamento y en las Normas;

XIX. To have the official documents, reports of results and compliance certificates in matters of Occupational Health and Safety, determined in this Regulation and in the Standards;

XX.       Supervisar que los contratistas cumplan con las medidas de Seguridad y Salud en el Trabajo, que señalan este Reglamento y las Normas, cuando realicen trabajos dentro de sus instalaciones;

XX. Supervise that contractors comply with the Occupational Health and Safety measures that are stipulated in this Regulation and the Standards, when they carry out tasks within their installations;

XXI.      Permitir y facilitar el ejercicio de las funciones de inspección y vigilancia por parte de la Autoridad Laboral, para cerciorarse del cumplimiento de la normativa en materia de Seguridad y Salud en el Trabajo, y

XXI. To permit and facilitate the exercise of the duties of inspection and oversight on the part of the Labor Authority, in order to verify compliance to the regulatory instruments in matters of Occupational Health and Safety, and

XXII.    Las demás previstas en otras disposiciones jurídicas aplicables.

XXII. All others detailed in other applicable legal provisions.
