CONSIDERANDO

CONSIDERING

Que con fecha 13 de noviembre de 2007, en cumplimiento de lo previsto por el artículo 46 fracción I de la Ley Federal sobre Metrología y Normalización, la Secretaría del Trabajo y Previsión Social presentó ante el Comité Consultivo Nacional de Normalización de Seguridad y Salud en el Trabajo, el Anteproyecto de Modificación de la presente Norma Oficial Mexicana y que el citado Comité lo consideró correcto y acordó que se publicara como Proyecto en el Diario Oficial de la Federación;

That on the 13^st of November of 2007, in compliance to that detailed in article 46 section I of the Federal Law on Metrology and Standardization, the Secretary of Labor and Social Welfare presented before the National Consultative Committee of Standardization of Occupational Health and Safety, the Pre-Project of Modification of this Official Mexican Standard and that the cited committee considered it correct and agreed to its publication as Project in the Official Daily of the Federation;

Que con objeto de cumplir con lo dispuesto en los artículos 69-E y 69-H de la Ley Federal de Procedimiento Administrativo, el Anteproyecto correspondiente fue sometido a la consideración de la Comisión Federal de Mejora Regulatoria, la que dictaminó favorablemente en relación al mismo;

That for the purpose of complying with the provision in articles 69-E and 69-H of the Federal Law of Administrative Procedure, the corresponding Pre-Project was submitted to the consideration of the Federal Commission of Regulatory Improvement, which resolved favorably in relation to the same;

Que con fecha 29 de abril de 2008 en cumplimiento del Acuerdo del Comité Consultivo Nacional de Normalización de Seguridad y Salud en el Trabajo y de lo previsto por el artículo 47 fracción I de la Ley Federal sobre Metrología y Normalización, se publicó en el Diario Oficial de la Federación el Proyecto de Modificación a la Norma Oficial Mexicana NOM-001-STPS-1999, Edificios, locales, instalaciones y áreas en los centros de trabajo-Condiciones de seguridad e higiene, para quedar como PROY-NOM-001-STPS-2007, Edificios, locales, instalaciones y áreas en los centros de trabajo-Condiciones de seguridad, a efecto de que, dentro de los siguientes 60 días naturales a dicha publicación, los interesados presentaran sus comentarios al Comité Consultivo Nacional de Normalización de Seguridad y Salud en el Trabajo;

That on the 29^th of April of 2008, in compliance to the Agreement of the National Consultative Committee of Standardization of Occupational Safety and Health and of that detailed in article 47 section I of the Federal Law on Metrology and Standardization, the Project of Modification of the Official Mexican Standard Official Mexican Standard NOM-001-STPS-1999, Buildings, locales, installations and areas in the workplace – Safety conditions, to remain as PROY- NOM-001-STPS-2007, Buildings, locales, installations and areas in the workplace – Safety conditions, was published in the Official Daily of the Federation so that within the 60 calendar days following said publication, the interested parties might present their comments to the National Consultative Committee of Standardization of Occupational Health and Safety;

Que habiendo recibido comentarios de seis promoventes, el Comité referido procedió a su estudio y resolvió oportunamente sobre los mismos, publicando esta dependencia las respuestas respectivas en el Diario Oficial de la Federación el 2 de octubre de 2008 en cumplimiento a lo previsto por el artículo 47 fracción III de la Ley Federal sobre Metrología y Normalización;

That having received comments from six parties, the referred to Committee proceeded with their study and resolved opportunely on the same, this department published the respective responses in the Official Daily of the Federation on the 2^nd of October of 2008, in compliance to that detailed in article 47 section III of the Federal Law on Metrology and Standardization;

Que derivado de la incorporación de los comentarios procedentes, presentados para el Proyecto de Modificación a la Norma Oficial Mexicana NOM-001-STPS-1999, Edificios, locales, instalaciones y áreas en los centros de trabajo-Condiciones de seguridad e higiene, para quedar como PROY-NOM-001-STPS-2007, Edificios, locales, instalaciones y áreas en los centros de trabajo-Condiciones de seguridad, así como de la revisión final del propio proyecto, se realizaron diversas modificaciones con el propósito de dar claridad, congruencia y certeza jurídica en cuanto a las disposiciones que aplican en los centros de trabajo, y

That derived from the incorporation of the comments to the Project of Modification to the Official Mexican Standard NOM-001-STPS-1999, Buildings, locales, installations and areas in the workplace – Safety conditions, to remain as PROY- NOM-001-STPS-2007, Buildings, locales, installations and areas in the workplace – Safety conditions, as well as the final review of the same project, several modifications were made for the purpose of giving clarity legal  congruence and legal certainty in the provisions that apply in the workplace,  and

Que en atención a las anteriores consideraciones y toda vez que el Comité Consultivo Nacional de Normalización de Seguridad y Salud en el Trabajo otorgó la aprobación respectiva, se expide la siguiente:

That in attention to the latter considerations and once the National Consultative Committee of Standardization of Occupational Health and Safety, granted the respective approval, the following is issued:

1. Objetivo

1. Objective

Establecer las condiciones de seguridad de los edificios, locales, instalaciones y áreas en los centros de trabajo para su adecuado funcionamiento y conservación, con la finalidad de prevenir riesgos a los trabajadores.

To establish the safety conditions for buildings, locales installations and areas in the workplace, for their adequate functioning and conservation, for the purpose of preventing risks to workers.

2. Field of application

La presente Norma rige en todo el territorio nacional y aplica en todos los centros de trabajo.

This Standard regulates within the national territory and applies in all workplaces.

4. Definiciones

4. Definitions

Para efectos de esta Norma se establecen las definiciones siguientes:

For the purposes of this Standard the following definitions are established:

4.1 Alcayata: clavo metálico con ángulo recto incrustado o soldado a un poste para configurar peldaños de una escala fija.

4.1 Metal spike: metal stud with a straight angle inset or welded to a post for configuring rungs to a stationary ladder.

4.2 Ancla: elemento que sirve para afianzar cualquier estructura a pisos, paredes, techos y a otras partes de la construcción.

4.2 Anchor: Element that serves for securing any structure to floors, walls, roofs, and other parts of the construction.

4.3 Autoridad del trabajo: autoridad laboral: son las unidades administrativas competentes de la Secretaría del Trabajo y Previsión Social, que realicen funciones de inspección en materia de seguridad y salud en el trabajo, y las correspondientes de las entidades federativas y del Distrito Federal, que actúen en auxilio de aquéllas.

4.3 Work authority; labor authority: The appropriate administrative units of the Secretary of Labor and Social Welfare that carry out inspection operations in matters of occupational health and safety and those corresponding to the States and the Federal District, that act as auxiliaries to the Federal authorities.

4.4 Centro de trabajo: todos aquellos lugares tales como edificios, locales, instalaciones y áreas en los que se realicen actividades de producción, comercialización, transporte y almacenamiento o prestación de servicios, o en los que laboren personas que estén sujetas a una relación de trabajo.

4.4 Workplace: All those places such as buildings, locales, installations and areas in which activities of production, commercial distribution, transport and warehousing or rendering of services or those in which persons labor that are subject to a labor relationship. (employer-employee).

4.5 Condición insegura: circunstancia física peligrosa en el medio en que los trabajadores realizan sus labores (ambiente de trabajo), y se refiere al grado de inseguridad que pueden tener los locales, la maquinaria, los equipos y los puntos de operación.

4.5 Unsafe condition: hazardous physical circumstance in the environment in which the workers perform their labors (work environment) and refers to the degree of the lack of safety that the locales, machinery, equipment, and points of operation can have.

4.6 Conservación: actividades de mantenimiento preventivo y correctivo para realizar las adecuaciones, modificaciones o reparaciones de los edificios, locales, instalaciones y áreas en los centros de trabajo.

4.6 Conservation: preventive and corrective activities of maintenance for performing the adaptations, modifications or repairs of the buildings, locales, installations, and areas in the workplace.

4.7 Escalas fijas: peldaños consecutivos que están permanentemente sujetos a una superficie vertical y sirven para acceder ocasionalmente a tejados, pozos, silos, torres, chimeneas y otras zonas.

4.7 Stationary ladders: consecutive rungs that are permanently secured to a vertical surface and serve for occasionally accessing roofs, wells, silos, towers, chimneys and other zones.

4.8 Escalas móviles; escaleras portátiles; escaleras manuales: aparato portátil que consiste en dos piezas paralelas o ligeramente convergentes unidas a intervalos por travesaños y que sirve para subir o bajar a una persona de un nivel a otro.

4.8 Mobile ladders; portable stairs, manual stairs: portable apparatus that consists in two parallel pieces or lightly convergent joined at intervals by crossbars and that serve a person  for ascending or descending from one level to another. 

4.9 Evento: fenómeno natural que puede afectar la seguridad estructural del centro de trabajo y/o aquellos actos incidentales que pueden afectar la seguridad estructural de las instalaciones.

4.9 Event: natural phenomenon that can affect the structural safety of the workplace and/or those incidental acts that can affect the structural safety of the installations.

4.10 Funcionamiento: se refiere al uso de edificios, locales, instalaciones y áreas en los centros
de trabajo.

4.10 Operation: refers to the use of buildings, locales, installations and areas in the workplace.

4.11 Material impermeable: aquel que tiene la propiedad de impedir o dificultar la penetración de agua u otro líquido a través de él.

4.11  Impermeable material:  that which has the property of impeding or making difficult the penetration of water or another liquid through it.

4.12 Nuevas construcciones: edificios, locales, instalaciones y áreas en los centros de trabajo que se encuentren en su etapa de diseño al momento de entrar en vigor la presente Norma.

4.12 New constructions: buildings, locales, installations and areas in the workplace that are found in the design stage at the moment of this Standard taking effect.

4.13 Puente; pasadizo: pasillo elevado por el que transitan trabajadores.

4.13 Bridge; passageway: elevated passage through which workers transit.

4.14 Registro: bitácora o cualquier medio magnético en el que se asienten los resultados de las verificaciones realizadas al centro de trabajo.

4.14 Registry: log or any electronic media in which the results are recorded of the verifications performed in the workplace.

4.15 Yaque: base de apoyo empleada en tráileres o autotanques para evitar que el vehículo se mueva cuando esté siendo cargado o descargado.

4.15 Jack: support base employed in trailers or tank trucks in order to avoid the vehicle from moving when it is being loaded or unloaded.

5. Obligaciones del patrón

5. Obligations of the employer

5.1 Conservar en condiciones seguras las instalaciones de los centros de trabajo, para que no
representen riesgos.

5.1 To conserve the installations of the workplace  in safe conditions so that they do not represent risks.

5.2 Realizar verificaciones oculares cada doce meses al centro de trabajo, pudiendo hacerse por áreas, para identificar condiciones inseguras y reparar los daños encontrados. Los resultados de las verificaciones deben registrarse a través de bitácoras, medios magnéticos o en las actas de verificación de la comisión de seguridad e higiene, mismos que deben conservarse por un año y contener al menos las fechas en que se realizaron las verificaciones, el nombre del área del centro de trabajo que fue revisada y, en su caso, el tipo
de condición insegura encontrada, así como el tipo de reparación realizada.

5.2 Perform visual verifications every twelve months in the workplace, they can be done by areas, in order to identify unsafe conditions and repair the damages encountered. The results of the verifications must be recorded in logs, electronically or in the verification reports of the Health and Safety Commission, the same that must be kept for a year and contain at least the dates in which the verifications were made, the name of the area of the workplace that was reviewed and, when applicable, the type of unsafe condition encountered, as well as the type of repair made.

5.3 Efectuar verificaciones oculares posteriores a la ocurrencia de un evento que pudiera generarle daños al centro de trabajo y, en su caso, realizar las adecuaciones, modificaciones o reparaciones que garanticen la seguridad de sus ocupantes. De tales acciones registrar los resultados en bitácoras o medios magnéticos. Los registros deben conservarse por un año y contener al menos la fecha de la verificación, el tipo de evento, los resultados de las verificaciones y las acciones correctivas realizadas.

5.3  Perform visual verifications after the occurrence of an event that could generate damages to the workplace and, when applicable, make the adaptations, modifications, or repairs that guarantee the safety of its occupants. Record the results of said actions in logs or electronic media. The records must be kept for one year and contain at least the date of the verification, the type of event, the results of the verifications and the corrective actions carried out.  

5.4 Contar con sanitarios (retretes, mingitorios, lavabos, entre otros) limpios y seguros para el servicio de los trabajadores y, en su caso, con lugares reservados para el consumo de alimentos.

5.4 Have clean and safe restrooms (toilets, urinals, sinks, among others) for the service of the workers and, when applicable, with places reserved for the consumption of food products.

5.5 Contar, en su caso, con regaderas y vestidores, de acuerdo con la actividad que se desarrolle en el centro de trabajo o cuando se requiera la descontaminación del trabajador. Es responsabilidad del patrón establecer el tipo, características y cantidad de los servicios.

5.5 Have, when applicable, showers and dressing rooms, according to the activity that is carried out in the workplace or when the decontamination of the worker is required. It is the responsibility of the employer to establish the type, characteristics and quantity of services.

5.6 Proporcionar información a todos los trabajadores para el uso y conservación de las áreas donde realicen sus actividades en el centro de trabajo, incluidas las destinadas para el servicio de los trabajadores.

5.6 Provide information to all the workers for the use and conservation of the areas where they carry out their activities in the workplace, including those designated for the service of the workers.
