STAYING UP TO DATE - NEW TRANSLATIONS ADDED TO THE SITE

  • NOM-010-ASEA-2016, Compressed natural gas (CNG). Minimum safety requirements for loading and discharging terminals of transportable storage modules and stations for supplying automotive vehicles. Published in the DOF on August 08, 2017 and takes effect February 09, 2018 Ready for download

  • NOM-003-ASEA-2016, Distribution of natural gas and liquid petroleum gas in pipelines. Published in the DOF August 18, 2017 – takes effect Feb. 4, 2018  Ready for download

  • Corporations and Partnerships Law (Ley de Sociedades Mercantiles) Reform published January 24, 2018 and takes effect July 25, 2018  Ready for download

  • FEDERAL LAW FOR THE PROTECTION OF THE CONSUMER (LEY FEDERAL DE PROTECCIÓN AL CONSUMIDOR) Reforms published January 11, 2018 and took effect January 12, 2018

NOM-010-ASEA-2016, Compressed natural gas (CNG). Minimum safety requirements for loading and discharging terminals of transportable storage modules and stations for supplying automotive vehicles. Takes effect January 12, 2018 and is now available in English for download or purchase.

This new Standard cancels and substitutes the Official Mexican Standard NOM-010-SECRE-2002, Compressed natural gas for automotive use. Minimum safety requirements for service stations, published in the Official Daily of the Federation on October 23, 2002.

NOM-003-ASEA-2016, Distribution of natural gas and liquid petroleum gas in pipelines. Published in the DOF August 18, 2017 – took effect Feb. 4, 2018  - and is now available in English for download or purchase.

This new Standard cancels and substitutes the Official Mexican Standard NOM-003-SECRE-2011, Distribution of Natural Gas and Liquid Petroleum Gas by Pipelines, and NOM-129-SEMARNAT-2006, Natural gas distribution systems. That establishes the specifications of environmental protection for the preparation of the site, construction, operation, maintenance and abandonment of natural gas distribution systems that are intended to be located in urban, suburban, and industrial areas, urban material support or support for services.

FEDERAL LAW FOR THE PROTECTION OF THE CONSUMER
(LEY FEDERAL DE PROTECCIÓN AL CONSUMIDOR) Reforms published January 11, 2018 - took effect January 12, 2018

These major reforms require: 

  • Vendors to clearly mark the prices of products and respect those labels. "Said amount must include taxes, commissions, interests, insurance and any other cost, charge, expense, or additional payment that is required to cover for reason of the respective acquisition or contracting, whether paid by cash or credit."

  • All persons involved in a transaction have personal liability when the rights of the consumer are infringed - all collaborators, subordinates, and all classes of managers, security, guards, or auxiliary personnel that render their services to them have personal responsibility.

  • Suppliers cannot apply coercive or unfair commercial methods or practices, nor abusive clauses or conditions or fees imposed on the storage of products or services.

  • Vendors cannot render additional services to those originally contracted that have not been expressly requested or accepted in writing or electronically, by the consumer, nor can they apply charges without the prior consent of the consumer.

  • Vendors cannot increase unjustifiably prices because of natural or meteorological phenomena or for sanitary contingencies.

  • Vendors to withdraw from the market the goods or products when it is determined irrefutably by the appropriate authority that they place the life or health of the consumer at risk

  • The Prosecutor for the Protection of the Consumer (PROFECO) can order the suspension of information or publicity that is misleading.

  • The Prosecutor will have a term of ten working days to enforce measures after an infraction has been reported.  

  • The minimum guarantee for any product or service is 90 days from the date of sale or contract.

GENERAL LAW OF CORPORATIONS AND PARTNERSHIPS
(LEY GENERAL DE SOCIEDADES MERCANTILES) Reforms published January 24, 2018 and take effect July 25, 2018

These major reforms consist: 

  • New rules for the dissolution of a corporation or partnership

  • New rules for the division of assets during a dissolution

AUDIT ALTERNATIVE - Is the cost of an audit not within your budget?

  WE HAVE AN ALTERNATIVE. We can audit, train and consult with your personnel on a monthly basis. We visit your site every month for 4 hours and each time we review a different part of your program and offer guidance and provide training for correcting any noncompliances. The following month we review the progress and review another part of your program and we bill you monthly at an hourly rate.
