Counsel of the Federal Judiciary – oversight of Federal courts - responsible for administration, oversight, discipline of the Federal Judiciary and for assuring the function and autonomy of the District Courts and Circuit Courts. They name district judges.

 

Supreme Court – the highest court in the nation, consists of 11 Ministers  (Ministros) that serve single terms of 15 years. Ministers are appointed by the President and the President of the Court is elected from the Ministers for four year terms.

 

Electoral Court of the Judicial Power of the Federation – This is the highest electoral court for resolving electoral disputes and oversee the quality and integrity of Mexico’s elections. This is the highest electoral court and there is no appeal.

 

Circuit courts – Federal courts that according to the number of magistrates  (magistrados) are either Unitary or Collegiate (Unitarios o Colegiados) are distributed throughout the nation and are assigned certain geographical zones called judicial circuits (circuitos judiciales). There are presently 29 judicial circuits that can include several states.

 

o   Unitary Circuit Courts – are composed of one magistrate. As mentioned their jurisdiction is territorial, Federal, and they have legal jurisdiction (competencia)

·       Over Amparo lawsuits promoted against acts of other Unitary Circuit Courts that do not constitute a final judicial decision;

·       The recourse of appeal of a denied appeal;

·       The evaluation and qualification of recusals of District Judges (except Amparo)

·       Conflicts of legal jurisdiction between District Judges under their jurisdiction (except Amparo)

·       And all other matters assigned to them in Laws.

 

o   Collegiate Circuit Courts (Tribunales Colegiados de Circuito) Federal Courts composed of 3 magistrates, of one which is President. They can be specialized in a branch of law penal, administrative, civil or mercantile, and labor or they can be mixed. Their jurisdiction is territorial, Federal and they have legal jurisdiction (competencia) over:

·       Direct Amparos against final sentences,

·       arbitration decisions (such as labor decisions), or

·       against judicial decisions that end a judicial process for violations committed in them or during process;

·       Decisions, sentences pronounced by District Courts, Unitary Circuit Courts;

·       Recourse of complaint;

·       Recourse of review against constitutional decisions by District Judges, Unitary Circuit Courts;

·       Extraditions granted by the Executive branch at the request of foreign governments;

·       Conflicts of legal jurisdiction between Unitary Circuit Courts or District Judges for jurisdiction for Amparos.

 

District Courts – (Juzgados de Distrito) – are the first level courts of the Judicial Courts of the Federation. They consist of one District Judge. District Judges are named by the Counsel of the Federal Judiciary (Consejo de la Judicatura Federal)

 

·       They are responsible for resolving matters related to the application of Federal laws in matters of Civil, Penal, Administrative law or International treaties, and

·       Matters of Indirect Amparo in matters of Civil, Penal, Administrative, and labor. They can be limited or broad in scope.
