THE FEDERAL REGULATION OF OCCUPATIONAL HEALTH AND SAFETY  

Published in the DOF on November 13, 2014 effective February 13, 2015 cancels the current Regulation.

This Regulation has many new elements and raises all of the fines for not having the required documentation, the diagnostic for health and safety, risk studies, permits and licenses, documentation for training, etc. One important change is that all risk studies must now have an ergonomic element and all job positions must have a risk study with an ergonomic evaluation. Also added, is the requirement to have a driver safety program for any employee driving company vehicles and an emphasized joint responsibility for the health and safety compliance of sub-contractors performing work inside an installation.

1. The STPS (Labor department has provided an audit protocol that they refer to as a "Diagnostic of Health and Safety."  This has been offered as a Guideline for companies to use to evaluate their compliance. With the new Regulation, this Diagnostic is now a requirement and carries a fine of $3,364.50 a $6,729.00 pesos.
 
2. Risk Studies for machinery and equipment must now include an ergonomic study.
 
3 There must be a risk study for every job position that includes an ergonomic study.
 
4. Every company with more than 50 employees must have handicapped access in their entire site.
 
5. Companies are now required to have a driver safety program for all employees that drive company vehicles.
